JUDGE SANCTIONS ROBERT BRAZELL AND ATTORNEY CRAIG JACOBSEN WITH RULE 11 FOR FRIVOLOUS LAWSUIT

Utah Rule 11 Motion Argued Successfully By Robann Investment Group's Lead Attorneys John Merten and Don Flanary

 

A Rule 11 Motion is filed when a lawsuit or counterclaim is believed to have no merit, was filed without evidence, and/or to intimidate a party.

 

A Utah judge found that Robert Brazell and his counsel Craig T. Jacobsen from the Ogden, Utah Law Firm of Froerer & Miles, filed such a lawsuit against the Robann Investment Group that are plaintiffs in the Utah Securities Fraud Lawsuit.

 

Robert Brazell and his attorney Craig T. Jacobsen had filed a lawsuit claiming that all 50 members of the investment group had conspired to destroy Robert Brazell (claiming millions of dollars in damages), and that the plaintiff's counsel should be disqualified due to conflict of interest.

 

The Court denied the motion to disqualify the plaintiff's counsel. The Court found that the Counterclaim was filed in violation of Rule 11 (b)(1), "because it was filed for its in terrorem effect in obtaining leverage against Plaintiffs." The Court also found that the counterclaim had been "filed without either evidentiary support, or a likelihood of obtaining evidentiary support..." The Court dismissed the Counterclaims.

 

The Court also "RESERVED the issue of monetary sanctions under Rule 11(c)(2)."
